Course Release, Waiver, and Educational Disclaimer

Please read this Course Release, Waiver, and Educational Disclaimer (the "Agreement") carefully before enrolling in, purchasing access to, or participating in any course, program, workshop, download, or related educational material (each, a "Course") offered by Avery Neal, PhD, PLLC ("the Provider," "we," "us," or "our"). By enrolling, purchasing, or otherwise participating, you ("Participant," "you," or "your") acknowledge that you have read, understood, and agreed to be bound by this Agreement in full. Your enrollment, purchase, or access to the Course (including by clicking “I Agree,” checking an acceptance box, completing a purchase, or accessing any Course materials) constitutes your electronic signature and binding acceptance of this Agreement under the Electronic Signatures in Global and National Commerce Act (ESIGN), the Uniform Electronic Transactions Act (UETA), and any applicable state electronic signature laws. You agree that this electronic acceptance has the same legal effect as a handwritten signature.
If you do not agree to any part of this Agreement, do not enroll in or access the Course.
1. Educational Purpose of the Course
Each Course is provided solely for general educational and informational purposes. The Course delivers frameworks, concepts, research summaries, and skill-building material based on the Provider's professional expertise and experience. Course content is designed for a general audience and is not tailored to any individual's specific situation, history, symptoms, diagnosis, or circumstances.
2. No Therapeutic, Clinical, or Professional Relationship
Avery Neal is a licensed clinician. However, the Course is offered by the Provider in an educational capacity only, not in a clinical, therapeutic, medical, or professional treatment capacity.
By enrolling in or participating in the Course, you specifically acknowledge and agree that:
- No therapist-client, counselor-client, clinician-patient, or any other professional treatment relationship is formed between you and Avery Neal or the Provider by virtue of your enrollment, participation, communication, or completion of the Course;
- The Course does not constitute the practice of psychotherapy, counseling, clinical social work, mental health treatment, medical care, diagnosis, or the delivery of any licensed clinical service, regardless of the state, province, or country in which you reside;
- Any presence of Avery Neal in a Course — including through recorded video, written material, live sessions, community spaces, or written responses — is offered in her capacity as an educator and author, not as your treating clinician;
- The Provider does not accept any clinical duty of care to you, and no clinical, medical, or fiduciary obligations arise between you and the Provider through the Course.
- The Provider has no duty or obligation to monitor any Community Space, live session chat, email, written response, or other communication for signs of distress, crisis, clinical need, or harm. The Provider has no obligation to respond to any individual communication from you outside of general educational facilitation of the Course. Any response the Provider may choose to provide is offered solely in an educational capacity and does not create a clinical relationship, duty of care, or obligation to continue responding.
3. Not Medical, Mental Health, or Professional Advice
The Course is not intended to be, and is not, medical advice. The Course is not intended to be, and is not, mental health advice, psychological advice, psychiatric advice, or professional advice of any kind. We are not providing professional advice to you through the Course.
The Course is not intended to diagnose, treat, cure, prevent, or manage any medical condition, mental health condition, or any other condition. Course content is general educational material only and is not a recommendation, prescription, or professional opinion regarding your personal circumstances, symptoms, or health.
Always consult your physician, licensed mental health provider, or other qualified licensed healthcare professional regarding any question you may have about your health, a medical or mental health condition, medications, symptoms, or treatment. Never disregard, delay, or discontinue seeking or following professional medical or mental health advice because of anything you have learned from the Course. If you think you may have a medical or mental health emergency, follow the guidance in Section 7 below.
4. Not a Substitute for Professional Care
The Course is not a substitute for, and should not be used in place of, any of the following:
- Psychotherapy, counseling, or clinical mental health treatment;
- Psychiatric care or medication management;
- Medical diagnosis, treatment, or advice from a licensed physician or other qualified healthcare provider;
- Legal advice from a licensed attorney;
- Any other licensed professional service.
If you have or suspect you may have a mental health, medical, legal, or other condition or need requiring professional support, you should consult a qualified, licensed professional in your jurisdiction.
5. No Individualized Advice
Nothing in the Course — including written material, recorded video, live sessions, discussion posts, community spaces, downloadable resources, email correspondence from the Provider, or any other Course-related content — constitutes individualized advice of any kind. Course material presents general education and is not calibrated to your specific circumstances, history, condition, or needs. Any application of Course material to your own life is made at your sole discretion and at your own risk.
6. Personal Use and Personal Responsibility
Course content is provided for your personal growth and development only.
You may not use, apply, or offer Course content to advise, treat, counsel, coach, or provide any form of professional service to any other person, unless you are separately and independently qualified and licensed to do so within your own scope of practice — and you take full and independent responsibility for that use.
You are solely responsible for your own choices, decisions, and actions taken during and after your participation in the Course. This includes any decision to apply — or not to apply — Course material to your life, relationships, work, health, or circumstances. Any application of Course material is made at your sole discretion and at your sole risk. The Provider assumes no responsibility for the outcomes, effects, or consequences of any choices you make.
7. Content Nature and Assumption of Risk
You understand that the Course addresses subject matter that may include, among other topics, psychological dynamics, emotional patterns, relational experiences, and material related to psychological abuse and its effects. This material can be intellectually and emotionally activating, particularly for individuals with personal histories in the topics discussed.
By enrolling in the Course, you acknowledge and voluntarily assume the risk that engagement with Course material may:
- Bring up difficult emotions, memories, or reactions;
- Trigger or intensify distress, including in ways not fully predictable in advance;
- Not produce any specific outcome, benefit, or improvement in your circumstances;
- Not be suitable for your particular history, condition, or timing.
You agree that you are the sole judge of whether it is appropriate for you to engage with Course material at any given time. You agree to pause, discontinue, or seek professional support at any point you determine that continued engagement is not in your best interest. Where appropriate, you agree to consult a qualified mental health professional before, during, or after engaging with the Course.
You further represent and warrant that, at the time of enrollment and throughout your participation, you are not currently in acute crisis, actively suicidal, or seeking emergency support through the Course, and that you have the legal capacity to enter into this Agreement. If at any time you determine you are in crisis or that continued engagement is not appropriate, you agree to immediately discontinue use of the Course and seek appropriate professional support as described in Section 8.
8. Crisis, Emergency, and Safety Situations
The Course is not designed to respond to crisis situations, and neither the Course nor the Provider provides emergency or crisis services.
If you are in crisis, in danger of harming yourself or another person, in a situation involving abuse or violence, or facing any other emergency, do not rely on the Course for support. Instead, immediately contact one or more of the following:
- In a life-threatening emergency: Call 911 (in the United States) or your local emergency services number, or go to your nearest emergency room.
- Suicide and mental health crisis (United States): Call or text 988 to reach the 988 Suicide & Crisis Lifeline, available 24/7. You can also chat online at 988lifeline.org.
- Crisis Text Line (United States, Canada, UK, Ireland): Text HOME to 741741.
- Domestic violence (United States): Contact the National Domestic Violence Hotline at 1-800-799-7233, or text START to 88788, or visit thehotline.org.
- SAMHSA National Helpline (mental health and substance use, United States): 1-800-662-4357, available 24/7.
- Outside the United States: Contact your local emergency services or the international suicide hotline directory at findahelpline.com.
If you are seeking ongoing individualized mental health care, you can locate a licensed provider through directories such as Psychology Today (psychologytoday.com), the American Psychological Association Psychologist Locator (locator.apa.org), or a licensed provider directory in your country of residence. The Provider does not monitor the Course or any related communications for crisis situations and has no obligation to identify, intervene in, or respond to any crisis or emergency.
9. Community and Discussion Spaces
If the Course includes any community forum, group discussion space, live Q&A session, message board, or similar interactive component (each, a "Community Space"), the following applies:
- A Community Space is an educational peer-learning environment, not a therapy group. No clinical group treatment is provided in a Community Space, and no clinical group confidentiality applies.
- You are asked, as a community norm, to respect the privacy of other participants by not sharing anything posted by another participant outside of the Community Space, and by not identifying other participants by name outside the Community Space.
- This community norm is not clinical confidentiality, and the Provider cannot guarantee that other participants will honor it. You should assume that anything you share in a Community Space may be seen, read, or heard by other participants and may not remain private.
- You are responsible for what you choose to share. You are advised to share only what you are comfortable being read by others, and to avoid disclosing personally identifying details about yourself or any third party.
- The Provider reserves the right to remove content or participants that violate community norms, engage in harassment, share content that appears to constitute a request for individualized clinical support, or otherwise disrupt the educational purpose of the Course.
- Live sessions (if any) may be recorded by the Provider for educational, quality-assurance, or archival purposes. By participating, you consent to such recording and to the limited use of the recording consistent with the educational purpose of the Course. No clinical confidentiality applies to any recording.
- The Provider may, in its sole discretion, mute, remove, or permanently exclude any participant whose conduct disrupts the educational purpose, appears to request individualized clinical support, or otherwise violates community norms, without refund or liability.
10. Privacy of Your Information
Information you provide in connection with the Course — including account details, payment information, and any content you submit in a Community Space, live session, email, or written response — is handled as follows:
- We do not sell your personal information to any third party.
- We do not share your personal information with third parties for their marketing or advertising purposes.
- We may share information with service providers as reasonably necessary to operate the Course — including course hosting platforms, payment processors, email service providers, and analytics tools — subject to their own terms and privacy practices.
- We cannot guarantee absolute privacy or security. No online platform, database, transmission, storage system, or service can be guaranteed to be completely private or completely secure. Data breaches, unauthorized access, technical failures, and human error can occur despite reasonable safeguards, and you share any information at your own risk.
- We may be required by law to disclose information. The Provider may disclose your information when required to do so by law, subpoena, court order, warrant, or other legal process, or when we determine in good faith that disclosure is necessary to comply with a legal obligation, respond to a governmental or regulatory request, protect the safety of any person, prevent fraud, investigate suspected wrongdoing, or protect the rights or property of the Provider.
For full details on how your information is collected, used, stored, retained, and disclosed, please refer to the Provider’s separate Privacy Policy, which is incorporated into this Agreement by reference.
The Course is delivered through third-party platforms, payment processors, email service providers, video platforms, and other vendors selected by the Provider. The Provider is not responsible for, and you release the Released Parties from any liability arising out of, the acts, omissions, data practices, security incidents, outages, service interruptions, lost access, or technical failures of any such third party. You acknowledge that absolute privacy or uninterrupted access cannot be guaranteed and that any data you share is subject to the privacy and security practices of those third parties as well as the Provider’s Privacy Policy.
11. No Guaranteed Outcomes; Testimonials
Individual results from any Course vary based on numerous factors outside the Provider's control, including your background, circumstances, effort, timing, and support systems. The Provider does not guarantee any specific outcome, result, benefit, or improvement. Any testimonials or examples featured in Course marketing materials reflect individual participant experiences and are not typical, expected, or promised results for any other participant.
12. Age Requirement
The Course is intended for participants age 18 or older. By enrolling, you represent and warrant that you are at least 18 years of age. If you are under 18, you may not enroll in or participate in the Course. The Provider and Avery Neal operate under the laws and professional licensure of the State of Texas. Course content is general educational material and is not tailored to the laws, regulations, or professional standards of any other jurisdiction. If you reside outside Texas, you are solely responsible for determining whether your participation is lawful and appropriate in your location and for complying with all applicable local laws. No clinical license, authority, or duty of care is claimed or created outside the Provider’s home jurisdiction(s).
13. Intellectual Property
All Course content — including written material, video, audio, slides, worksheets, frameworks, models, methodologies, images, and any other material — is the intellectual property of the Provider or is used with permission. It is protected by copyright, trademark, and other applicable laws.
You are granted a personal, non-transferable, non-exclusive, non-sublicensable, revocable license to access and use the Course content for your own personal educational purposes only. You may not reproduce, distribute, publicly perform, publicly display, adapt, sell, license, share, upload, or otherwise use the Course content outside of your own personal use without the Provider's prior written consent.
14. Assumption of Risk, Release, Waiver of Liability, and No Liability Exposure
You accept and agree that the Provider and Avery Neal individually have no liability exposure to you for any outcome, effect, or consequence arising from your enrollment in, participation in, or use of the Course. This release, waiver, and assumption of risk apply even if a refund is later issued under any separate refund policy, and survive any termination of your access to the Course or this Agreement.
To the fullest extent permitted by applicable law:
You voluntarily assume all risks associated with your enrollment in and participation in the Course, including but not limited to any emotional, psychological, physical, financial, relational, or other risks or outcomes.
You, on behalf of yourself and your heirs, personal representatives, executors, successors, and assigns, hereby release, waive, discharge, and covenant not to sue the Provider, Avery Neal individually, and any of the Provider’s officers, employees, contractors, agents, affiliates, or representatives (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, costs, or expenses (including attorneys’ fees) of any kind — whether known or unknown, anticipated or unanticipated — arising out of, connected with, or in any way related to your enrollment in, access to, participation in, or use of the Course, including any content, community space, communication, or other element of the Course.
This release applies to all claims, including but not limited to claims for negligence, emotional distress, personal injury, retraumatization, adverse mental health outcomes, financial loss, professional loss, relational impact, and any other harm.
This waiver does not apply to conduct that cannot lawfully be waived under applicable law, including gross negligence, willful misconduct, or fraud where such waiver is prohibited by the law of your jurisdiction.
15. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will the Released Parties be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the Course or this Agreement, regardless of the theory of liability and even if the Released Parties have been advised of the possibility of such damages.
The total aggregate liability of the Released Parties to you for any and all claims arising out of or related to the Course or this Agreement will not exceed the total amount you paid for access to the specific Course giving rise to the claim. The foregoing limitations apply to the fullest extent permitted by law and survive any termination of this Agreement or your access to the Course.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your breach of this Agreement, (b) your violation of any applicable law or the rights of any third party, or (c) your use of Course content in any manner not expressly permitted by this Agreement.
17. Governing Law and Jurisdiction
This Agreement is governed by and will be construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to this Agreement or the Course will be brought exclusively in the state or federal courts located in Montgomery County, Texas, and you consent to the personal jurisdiction and venue of those courts.
18. Severability
If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement will remain in full force and effect.
19. Entire Agreement
This Agreement, together with any other written terms expressly incorporated by reference (including any separate Terms of Service and Privacy Policy), constitutes the entire agreement between you and the Provider regarding the Course and supersedes any prior or contemporaneous understandings or agreements.
20. Changes to This Agreement
The Provider reserves the right to update or modify this Agreement from time to time. Material changes will be communicated by posting an updated version on the Course platform or by other reasonable notice. Continued access to or participation in the Course after such changes take effect constitutes acceptance of the updated Agreement.

Acknowledgment and Consent
By enrolling in, purchasing access to, or participating in the Course, you acknowledge and agree that:
- You have read and understood this Agreement in full;
- You are at least 18 years of age;
- You are entering into this Agreement voluntarily, of your own free will;
- You understand the Course is educational and does not create a clinical or therapeutic relationship;
- You understand the Course is not medical, mental health, or professional advice, and is not a substitute for professional care;
- You understand Course content is for your personal growth and development only, and you are solely responsible for your own choices, decisions, and actions;
- You understand that absolute privacy of any information cannot be guaranteed, and that the Provider may be required by law to disclose information in certain circumstances;
- You understand where to seek help in a crisis or emergency;
- You accept the assumption of risk, release, and waiver of liability set out above, and acknowledge that the Provider has no liability exposure to you arising from your participation in the Course.
- You understand that the Provider has no duty to monitor communications or Community Spaces for crisis or clinical need and has no obligation to respond to individual communications outside general educational facilitation;
- You understand that third-party platforms used to deliver the Course are outside the Provider’s control and that technical failures or data incidents involving those platforms do not create liability for the Provider;
- You represent that you are not currently in acute crisis and have the legal capacity to enter this Agreement;
- You understand that any live sessions may be recorded and that no clinical confidentiality applies.
